Local man faces 60 child porn counts

An area man, is facing nearly three centuries in prison if he is convicted of charges against him.
Virgil L. Kirian Jr., 51, of 548 N. Main St., in Marysville, has been indicted by a Union County Grand Jury on 60 counts of pandering sexually oriented material involving a minor. Of the charges, 30 are second-degree felonies and 30 are felonies of the fourth degree. If convicted on all charges, Kirian faces as many as 285 years in prison.
The indictments allege that between Sept. 1, 2007, and Oct. 30, 2007, Kirian, “did recklessly create, record, photograph, film, develop, reproduce or publish,” and that he did knowingly, “solicit, receive, purchase, exchange, possess or control,” images of children involved in specific sexually oriented activities.
The case against Kirian started as an Internet Crimes Against Children investigation. The ICAC unit is a collaborative effort of law enforcement agencies around the state that monitors the Internet for child pornography.
“The allegation is that he possessed child pornography, both possessed and created by virtue of downloading it through a file sharing program,” said Union County Prosecutor Dave Phillips..
He said that with the software program Kirian was allegedly using, when a file is downloaded to a computer, that computer becomes a server for the file. Once the image or movie is on a computer, you can send it to other people who see you have it and request it.
The prosecutor said it was the sharing of files that prompted the charges.
