A Mill Valley man could be facing a decade and a half in prison after allegedly sexually assaulting a child.
The Union County Grand Jury has indicted Timothy Daum, 58, of 345 Saddlebred Circle, Marysville. Daum is charged with three counts of gross sexual abuse.
According to court documents, between 2012 and 2015, Daum repeatedly had sexual contact with a child who was 7 at the time the alleged abuse began.
Union County Prosecutor Dave Phillips said the man knew the victim. He said Daum would touch the girl, “in a sexual manner and have the young, pre-teen touch him in a sexual manner.”
He said the girl went into treatment “at least in part as a result of the sexual assault.”
“During these treatment sessions, this came to light,” Phillips said.
The prosecutor said it is not unusual for an allegation like this to become known during a therapy session. He said it is “also not unusual” to see incidents reported days later.
If convicted, Daum could face as many as 15 years in prison.
Also indicted was:
Codefendants Angelo Dominic Tocci and Christy L. Fuchs.
Tocci, 43, of 16525 Martin-Welch Road, Marysville, is charged with two counts of aggravated possession of drugs and one count each of aggravated trafficking in drugs and illegal use or Possession of Drugs.
Fuchs, 52, of 148 Mound St., London, is charged with one count of aggravated possession of drugs.
Union County Prosecutor Dave Phillips said that on Sept. 9, Tocci was driving on U.S. 33.
“He was hiding as he passed the deputy,” Phillips said. “The deputy observed some traffic violations and initiated a traffic stop.”
Fuchs was a passenger in the car. Tocci allegedly agreed to allow law enforcement officials to search his vehicle. Investigators found methamphetamines in the car.
On Sept. 27, Tocci was again driving and had Fuchs with him. When he saw a deputy, Tocci allegedly tried to hide again. The deputy saw Tocci and knew he had a suspended license. The deputy stopped the car and again searched it. The investigators found 26.65 grams of methamphetamines, Phillips said.
Phillips said the Tocci faces a lengthy prison sentence because of the amount of methamphetamines. He said three grams is considered a bulk amount of meth.
Lt. Jeff Stires with the Union County Multi Agency Drug Enforcement Task Force said that 26.65 grams is nearly an ounce and is about 100 uses of the drug.
“A user does not buy an ounce of meth unless they plan to sell it,” Stires said, noting that an ounce sells for about $500.
He explained, “a user will use about a quarter of a gram each use.”
Phillips said Fuchs faces lesser charges because the drugs apparently belonged to Tocci.
“Just being in the presence of drugs is not enough to show knowledge or possession,” Phillips said. “There has to be some evidence they knew or actually possessed.”
Phillips said that while heroin and opioids remain a problem, methamphetamine use is on the rise quickly.
“We are seeing more and more meth coming into the area,” Phillips said.
He added that while there is money now for heroin treatment, “that isn’t the case for methamphetamines.”
