A Marysville man is facing a variety of felony charges after allegedly getting a girl drunk then having sex with her.
A grand jury has indicted Wyatt Markus Fraker, 24, of 449 Windmill Drive, Marysville, charging him with two counts of sexual battery, one count of gross sexual imposition, one count of tampering with evidence, six counts of pandering obscenity involving a minor and 58 counts of illegal use of a minor in nudity-oriented material or performance.
Union County Prosecutor Dave Phillips said the indictments involved both a local child and photographs of unknown children.
According to court documents, on June 20, Fraker provided alcohol for a 16-year-old girl. He then allegedly had sexual conduct with the girl knowing the girl “submitted because she was unaware the act was being committed.”
Phillips said that the age of consent in Ohio varies depending on the age of the age of the suspect. He said it doesn’t matter how old the child is if there is alcohol involved.
Phillips said that as investigators began looking into the matter, they found a few photographs of the girl and many photos of other children.
“Most of the photographs recovered were not of the child involved in the local incident,” Phillips said.
He said that some of the photographs were exploitative pictures of children in various stages of nudity and some of the photographs depicted “abuse” of the children.
If convicted on all counts, Fraker could face as many as 90 years in prison.
In 2013 Fraker pleaded no contest to charges of public indecency and menacing involving a girl. He was sentenced to jail time, though he served less than half and was released due to overcrowding in the Tri-County Regional Jail. Since that time, he has been convicted of at least six probation violations, including one for failing to complete a diversion program to help him deal with mental health issues.
Also indicted was:
- James Joseph Gleason, 51, of 324 W. Ottawa St., Richwood. Gleason is charged with two counts of operating a motor vehicle under the influence of alcohol.
According to court documents, about 11:22 p.m., April 28, 2018, Gleason was driving north on North Franklin Street in Richwood. He was pulled over by police for a headlight violation. When the officer began to speak with Gleason, it was suspected the man was drunk. A Breathalyzer test revealed that Gleason allegedly had a blood alcohol level of 0.182.
According to court documents, Gleason has five prior drunk driving convictions. Operating a vehicle under the influence is often charged as a misdemeanor, however, once an individual has a prior conviction, additional allegations are charged as felonies.
“There are times a person goes out and has a drink and doesn’t maybe realize they are drunk, but when you have multiple offenses, we know these people are a danger to everybody, to you, to me, to everybody on the road,” Phillips said.
The prosecutor added, “These are only the times he was caught.”
Prosecutors are asking to have Gleason ruled as a repeat offender. The ruling would add years to a potential prison sentence. If convicted, Gleason could face as many as 10 years in prison.
- Tory Dean Stover, 28, of 170 N. Franklin St., Delaware. Stover is charged with one count each of aggravated trafficking in drugs and aggravated possession of drugs. According to court documents, on Dec. 7, Stover was arrested with a “bulk” amount of methamphetamine. If convicted, on both counts, Stover could face as many as 10 years in prison.
